What is and how to write an affidavit of service?
A free affidavit of service sample is a written statement that is made under oath and is used to prove that legal documents have been served to the intended recipient. To write an affidavit of service, follow these steps:
- Begin with the heading or caption of the case and the name of the court where the case is pending.
- Identify yourself as the person who served the legal documents and state your qualifications for doing so (e.g. you are over 18 years old and not a party to the case).
- Describe the legal documents that were served, including the date they were served and the method of service (e.g. by mail, personal delivery, or by a process server).
- Provide the name and address of the person to whom the legal documents were served and describe how you know that the person is the intended recipient.
- If the legal documents were served by mail, state the date the envelope was sent and the address it was sent to.
- If the legal documents were served by a process server, state the name of the process server and the date and time the legal documents were served.
- Sign the affidavit in front of a notary public, who will also sign and stamp the affidavit to confirm that you swore to the truth of the statements made in the affidavit.
- Submit the Affidavit of Service to the court or person who required it.
